The Supreme Court of Canada says it will not hear the Toronto Real Estate Board’s appeal of a ruling on whether home sale data can be made available to the public.
Analysts have said that the Supreme Court challenge was likely the real estate board’s last legal avenue to stop the publication of the data.
The data has been the subject of a long-running fight between the real estate board and the Competition Bureau, which has argued that TREB policies preventing historical home sale prices from being released stifle competition in the industry.
Arguments from the real estate board have focused on claims that publishing the data would violate consumer privacy and copyright laws.
The Competition Tribunal and Federal Court of Appeal have both ruled in favour of the Competition Bureau, prompting the real estate board to take their case to Canada’s top court.
Lawyers and realtors have said that publication of the data will allow buyers and sellers to educate themselves on how to price their homes and negotiate without needing as much advice from real estate agents.
