A Tim Hortons franchisee who was the lead plaintiff on a class-action suit against the company is no longer with the coffee-and-doughnut chain's parent company after reaching an agreement with Restaurant Brands International.
Mark Kuziora operated two locations in Toronto and was an outspoken member of an unsanctioned franchisee group started more than a year ago, the Great White North Franchisee Association.
He filed a $4 million lawsuit against RBI after the company allegedly refused to renew a licence that expires at the end of August for one of his two stores in bad faith.
The company maintained it was right in its decision not to approve a new restaurant agreement.
GWNFA president David Hughes says in a letter to members that Kuziora and RBI reached an agreement and Kuziora is no longer with the chain.
He says the group "tried everything" in order to get RBI to rescind Kuziora's situation, but is suspicious that the company's goal was to send a message to its board.
RBI and Tim Hortons did not immediately respond to a request for comment, however the company has been reluctant to talk to GWNFA representatives. Instead, RBI chooses to rely on its elected franchisee advisory board, whose scope it expanded in recent months in an effort to ease ongoing disagreements with some franchisees.
